The European Commission has decided not to extend the Consortia Block Exemption Regulation (CBER) beyond April 2024, which exempts liner shipping consortia from EU antitrust rules, having concluded that it no longer promotes competition in the shipping sector.
EU antitrust rules generally ban agreements between companies that restrict competition, although the CBER allows shipping lines with a combined market share of below 30% to enter into cooperation agreements to provide joint cargo transport services, also known as consortia.
Following the Commission’s decision, the CBER will expire on April 25, 2024 although this does not mean that cooperation between shipping lines will become unlawful under EU rules.
